Terms of use

The ground rules for buying and selling vehicles on 21ST AURA, an Aotearoa New Zealand marketplace. Last reviewed 12 September 2026.

1. Who you are agreeing with

By creating an account or using the site you agree to these terms.

2. What 21ST AURA is

21ST AURA is an online marketplace that lets people in New Zealand advertise vehicles and contact each other. We provide the platform only. We are not the seller of any vehicle, we do not inspect vehicles, and we are not a party to any sale between a buyer and a seller.

Any agreement to buy or sell a vehicle is made directly between the buyer and the seller.

3. Money and payment

21ST AURA does not hold, receive, transfer or release money. There is no escrow, deposit-holding or payment-processing service on the platform. All payments are made directly between buyer and seller, at their own risk and arrangement.

Where the platform shows deal steps such as a deposit or handover, these are a shared record that the buyer and seller choose to keep. A recorded step is not proof that money moved, and 21ST AURA does not verify payments.

Never send money to someone you have not verified, and confirm cleared funds before handing over a vehicle or signing transfer paperwork.

4. Accounts

You must be at least 18 to create an account. Keep your password secure, use accurate details, and do not share or transfer your account. We may suspend accounts that breach these terms.

5. Private sellers

Private sellers must accurately describe their vehicle, including any damage and any money owing on it. The declarations you accept when publishing are part of these terms.

Private sales are generally not covered by the Consumer Guarantees Act 1993, but the Fair Trading Act 1986 still prohibits misleading or deceptive conduct by anyone.

6. Motor vehicle traders

If you are in the business of selling vehicles, New Zealand law may require you to be registered under the Motor Vehicle Sales Act 2003 and to comply with the Fair Trading Act 1986 and the Consumer Guarantees Act 1993.

Traders must display a Consumer Information Notice (CIN) with every used motor vehicle offered for sale. 21ST AURA requires CIN information before a trader listing can be published, but providing fields for it does not guarantee your legal compliance — meeting your obligations remains your responsibility.

Listings must be marked accurately as trader or private. 21ST AURA does not present a private seller as a trader, or a trader as a private seller. Misrepresenting trader sales as private sales is prohibited and may breach the Fair Trading Act.

7. Accuracy of listings

You must not list vehicles you do not have the right to sell, misstate the odometer, year, price, condition, damage or finance status, or use photos of a different vehicle. Our selling rules form part of these terms.

We may suspend or remove listings and accounts that breach these terms or are reported and upheld after review.

8. Acceptable use

Do not use the platform to harass, defraud or mislead others, to harvest personal information, to scrape content, or to interfere with the service. Messaging is for genuine enquiries about listings.

9. Content you post

You keep ownership of your listing text and photos, and you grant us a licence to host and display them so the marketplace can operate. You confirm you have the right to use the photos you upload.

10. No guarantees

21ST AURA gives no legal, mechanical, finance, valuation or vehicle-history guarantees. We do not verify ownership, odometer readings, damage history or security interests. Listing information comes from sellers and should be independently checked.

11. Liability

To the extent permitted by New Zealand law, 21ST AURA is not liable for the condition, ownership, description or history of any vehicle, for the conduct of buyers or sellers, or for any loss arising from a sale arranged through the platform.

Nothing in these terms limits any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be contracted out of.

12. Privacy

We handle personal information in line with the Privacy Act 2020 and our privacy policy, which explains what we collect, why, who we share it with, and how to make an access, correction or deletion request.

13. Suspension and termination

We may suspend or remove listings or accounts that breach these terms, our selling rules, or the law. You can stop using 21ST AURA at any time and request deletion of your account information.

14. Changes and governing law

We may update these terms as the service develops; the current version is always on this page. These terms are governed by New Zealand law and the New Zealand courts have jurisdiction.
